Image Usage License Agreement is conveyed to the client on receipt of payment in full.

Agreement: MLS Images, and the photographer, grants our client, upon payment in full, the non-transferable and non-assignable use of images for the exclusive purpose of marketing and advertising an active home for sale, or commercial property, and their own personal business.

MLS Images and the photographer grants our client the non-exclusive license, to publicly display on the client's website, web advertisements, social media, printed marketing, and for the distribution and syndication via MLS IDX feed on receipt of full payment. Links to the images and tours we provide are disabled after 30 days.

Use: Unauthorized third-parties is expressly prohibited from transmitting, broadcasting, selling, licensing, printing, distributing or otherwise using or exploiting our work in any manner. Brokers with an IDX feed are licensed to use the photographs exclusively for the purpose of marketing and active for sale property.

Provisions: MLS Images retains all copyright to images delivered to the client as well as any other rights which may not be detailed in this agreement. Selling, transferring, or redistribution of photographic images, 360 images, and video by the client is forbidden.

You are required to either return or destroy copies of the images at the end of use.

Indemnity: The Client indemnifies and holds harmless MLS Images, and the photographer, against all claims, liability, damages, costs and expenses stemming from a breach of this agreement, the use of the image, or modifying the image; your failure to abide by any restriction regarding the use of an image, modification of the image, or any claim by a third party related to the use of the image or modification of an image.

Our Copyright is protected by federal law under the United States Copyright Act, to ensure we receive the full protection of federal copyright law, MLS-Images retains the copyright to all our work. We reserve the right to pursue penalties and other remedies to the fullest extent allowed by the US Copyright Act. If you choose to violate our rights, we will send you an invoice reflecting the unauthorized use of our images, and violation of the non-exclusive license of our client who paid for a license.

Unlicensed usage is protected by United States Copyright Act with statutory damages ranging between $750 to $150,000 PER IMAGE REGUARDLESS OF HOW LONG THE IMAGE WAS USED.

Unlicensed use of our images for any personal or commercial use is $1,000 per image and $3000 per video. This represents the actual recognized value of the image or video used and its impact on our brand, our marketing and the brand of our clients. Our images are capture using a Patent Pending method that provides an Iconic and unique look to our images.

Statement of Terms for the State of Texas Sales Tax Compliance: MLS Images reserves the right, title and interest to the photographs, images, video and all other types of media in our name, MLS Images, inc (A.K.A. MLS-Images). MLS-Images grants a non-transferable image and video media usage license in the form of a temporary interest to our client. The images are for the purposes of syndication on MLS, marketing the property, and/or your business. You are required to either return or destroy copies of the images within 1 year or at the end of use.

We use a proprietary method, equipment and software we designed to capture our images. The results clearly differentiate our product from others on the market. We do not exposure blend. We do not sell our copyrights. When you use our work product without licensing you are taking another person's property without legal right, our clients hard worked for branding, in addition to our property.

Plain English Translation

You, Our Client may use the images as you please on the internet, in your printed material, on a billboard: anywhere; as long as you have paid us.

You may not sell or transfer the use of the images to the home-owner, another agent, your broker, or any other person or entity for business activities that are not specifically related to your own business ventures specifically related to selling the home and marketing your business.

We, MLS Images, own the copyright and retain all rights, title and intrest to the images and videos.

Our copyright is valued as sacred; we do not transfer or sell our rights to the images we take. We will pursue legal action for the theft of our property. Yep - we are serious about our copyright and need to make sure you understand our position and intent to protect our rights and our clients the brand.

Like what you see on the MLS and use it without our license agreement? Expect us to send you an invoice for the use of each individual image. Yep, really!
